General

✦ I have the right to decline a commission order without further explanation.
✦ You must be at least 18 years of age. I take no responsibility for minors providing false information about their age to me.
✦ I reserve the right to modify these Terms and Conditions at any time without notice to you.
✦ Always credit my work with my Twitter(X) handle @chiichiwi

Reference Requirements From Clients

✦ Currently, I do not offer character design services. Therefore, I will not design a character for you based on a character board, nor will I create a design for you using characters that do not belong to you.
✦ You must provide the following:
          ✧ A colored full-body reference of the desired character(s)
          ✧ Provide a description and inspiration for what you want the final artwork to look like.
          ✧ If the commission requires a background, provide a description and or visual reference for the background.
✦ I am not liable for inaccuracies due to insufficient references.

Revisions

✦ You are allowed to make three revisions during the process. Revisions will not be permitted past the rendering stage.
✦ What is considered a revision?
          ✧ Changing the original request after the sketch was approved, (changing the color of hair, changing the position of
          something if it was specified originally)
          ✧ Changing a significant part of the work after the sketch was approved. (change the entire face, change the whole
          hairstyle, add more muscle, etc.)
          ✧Additional requests after the sketch was approved (additional expressions, add a piece of clothing, remove a
          decoration, etc.)
✦ What is not considered a revision?
          ✧ Asking for minor changes during the whole process (add more eyelashes, add lipstick, etc.)
          ✧ Changing anything before the sketch is approved. (the whole pose, the expressions, clothing, etc.)
✦ Note that any significant changes will cause the commission to take longer than the set deadline.
✦ Any further revisions will incur additional charges, depending on the extent of the changes.

Deadline and Delivery

✦ The base timeframe for a commission is two weeks to a month; however, the deadline for each commission will be discussed with you, as the type of commission will vary.
✦ In any case, if the commission needs more time, you will be informed. However, if I am unable to complete the commission due to personal issues, I will notify you and allow you to request a refund.
✦ I do not take rush orders.
✦ Please inform me if you need the commission by a set deadline before accepting it.
✦ All WIPs will be sent with watercolor marks of my logo.
✦ The final product will be sent via Google Drive with a small watermark of my signature.

Use and Intellectual Property Rights

While you are permitted to use the artwork for specific purposes, I retain all copyrights to the artwork, which allows me to publish it on my social media platforms (Twitch, Twitter/X, Instagram, etc.) and portfolio to promote my work.

Personal Use

The personal-use license is free of charge.With the personal-use license, YOU MAY:
✦ Use it for your social media and streaming-related activities.
✦ Use as a profile picture or banner for your personal/streaming account.
✦ Repost the artwork to your personal account, but you are required to give proper credit to me, ChiiChiwi, by tagging me or providing links to my social media accounts.
✦ Print for display purposes only. You may not distribute merchandise, prints, or advertisements featuring the artwork.With the personal-use license, YOU MAY NOT:
✦ Resell the artwork.
✦ Create and distribute merchandise, prints, art books, or advertisements featuring the artwork.
✦ Use as a game asset, book cover, album art, etc.
✦ Remove my watermark.
✦ Heavily alter, claim, trace, or copy the artwork.
✦ Use the artwork in any form of blockchain-related technology, including any form of NFTs, cryptocurrency, or future inventions in the space.
✦ Use the artwork in any form of AI generation or AI-related products.

Commercial Use

✦ The commercial-use license fee is 100% of the final price.With the commercial-use license, YOU MAY:
✦ Create and distribute merchandise, prints, pins, stickers, etc.
✦ Request to remove my watermark for an additional charge.
✦ Repost the artwork to your account, but you are required to give proper credit to me, ChiiChiwi, by tagging me or providing links to my social media accounts.
✦ Use as a game asset, book cover, album art, etc.With the commercial-use license, YOU MAY NOT:
✦ Resell the artwork
✦ Heavily alter, claim, trace, or copy the artwork.
✦ Use the artwork in any form of blockchain-related technology, including any form of NFTs, cryptocurrency, or future inventions in the space.
✦ Use the artwork in any form of AI generation or AI-related products.

Payments

✦ Payments must be 100% upfront and must be made through VGen’s built-in payment systems.
✦ The commission will not be initiated until payment is made in full.
✦ Invoices must be paid within one week of receipt, or the commission will be cancelled.
✦ Fraudulent chargebacks will result in a block, forfeiture of any copyright over my work, and a public disclosure of your actions.

Refunds

✦ Once work starts, there will be no refunds.
✦ If the commission remains unfinished by the agreed-upon deadline and the client does not wish to extend it, they will be offered a full refund.
✦ I reserve the right to withdraw from completing a commission if problems arise that make me uncomfortable. Depending on the progress made on the art/time spent, you may be issued a full, partial, or no refund.
          ✧ However, if the reason for withdrawing from completing a commission is due to personal reasons, you will be issued a
          full refund.
✦ If a refund/chargeback is to take place, the artwork will not belong to you.
✦ I reserve the right to terminate a commission and refund the unfinished work if you violate the TOS or misbehave.

Communication

For any questions before initiating a commission, don't hesitate to get in touch with me via VGen or the Discord Server. Once commissions are accepted, all communications will be handled solely through my Discord Server dedicated to commissions. I will not tolerate negative messages/behavior.
